A Lynchburg, Va. federal court rejected an argument that an affidavit of support only allows a state-court breach of contract suit. It said the great majority of courts that have considered the issue have found that federal courts have jurisdiction for claims to enforce the affidavits. It also saw no problem with failing to attach a copy of the affidavit to the court filing, so long as the Twombly/Iqbal standard for stating a claim is met. Madrid v. Robinson, USDC W.D.Va., 10/31/16.
